The Chief Military Prosecutor's Office conducted an inspection on intellectual property legislation observance by officials of the military government, subordinated to the Chief of the Armed Forces of the Russian Federation and the Chief of Service of quartering resettlement of the Ministry of Defense of the Russian Federation, which are the general customer of research and development services.
The inspection detected violations of the existing legislation.
Due to these violations many results of intellectual activity over several years had not been registered with the Federal Agency for the Legal Protection of the results of intellectual activities of the military, special and dual character of the Ministry of Justice of the Russian Federation, as well as a special section in a single registry of the Defense Ministry of Russia. That created real prerequisites to loss of rights of the Russian Federation to the results of intellectual activity performed with the budget funds and their use to the detriment of the country's defense interests.
As a result of the inspection conducted by military prosecutors they submitted to Chiefs of the Armed Forces of the Russian Federation and the Service quartering and resettlement of the Ministry of Defence of the Russian Federation a document on eliminating the identified violations of the law, which is currently under review.
The officials responsible for the violations were brought to disciplinary liability. In addition, at the request of the military prosecutor's office in the main and central bodies of military administration of the Russian Defense Ministry there was conducted an inventory of the results of intellectual activity obtained for the period 2000 - 2006. In the section of the single registry of the Russian Defense Ministry there was a record made on the results of nearly 500 different research and development activities, with the budget funds spent on them totaling more than 2.6 billion roubles. To consolidate the rights for these research works for the Russian Federation, including the design of their state registration certificates, a set of measures was taken. At the same time, the command took additional measures aimed at strengthening the control of central authorities in the enforcement of martial law administration of MoD Russia in the area of intellectual activity and improving of public accounting of its results.
