Today, at the request of the Prosecutor General's Office of the Russian Federation, the competent authorities of Spain are extraditing to Russia Sergei Butorin, a citizen of the Russian Federation.
Butorin is accused of the commission of a number of crimes.
According to the request of the Prosecutor General's Office of the Russian Federation, dated July 17, 2000, Sergei Butorin, the head of the gang, and Marat Polyansky, a member of the gang, were arrested on 14 February 2001, in the city of Castelldefels (Spain). As during the arrest firearms were found on them, the court of Barcelona sentenced them to 8 years and 8 months of imprisonment.
On 28 December 2008 The Prosecutor General's Office of the Russian Federation forwarded to the competent authorities of Spain, anew request on extradition in order to bring Sergei Butorin to criminal liability for the organization of a criminal association and involvement in murders and attempted murders of more than 40 people.
Due to a long-term examination of the Russian request by the Spanish party, the issue on extradition of Sergei Butorin was discussed in the course of the working meeting of the delegation of the Prosecutor General's Office of the Russian Federation with the representatives of the Ministry of Justice of the Kingdom of Spain which took place in Madrid at the end of January 2010.
As a result of these negotiations, on 26 January 2010, the Government of Spain passed the final decision on extradition of the above person. After that Butorin filed to the competent authorities of the Kingdom of Spain an application for a refugee status. The Prosecutor General's Office of the Russian Federation, on its part, informed the Spanish colleagues that granting a status of a refugee to a person who is accused of so many grave and especially grave crimes would be a violation of the provisions of paragraph "b" paragraph F Article 1 of the Convention Relating to the Status of Refugees, of 28 July 1951. Taking into account the arguments and reasons of the Russian party, the Spanish colleagues did not allow to grant a refugee status to Butorin.
