Today, upon the request of the General Prosecutor's office of the Russian Federation, the competent authorities of the Republic of Cyprus are extraditing to Russia a citizen of the Russian Federation Dmitry Kotlyarenko.
By the investigation authorities he is accused of a crime foreseen by part 4 of article 159 (fraud, i.e. misappropriation of other's property by the method of deceit and breach of trust committed in particularly large amount by an organized group) of the Criminal code of the Russian Federation.
The criminal case against the mentioned person is in the execution stage of the Main investigative department of the Main Department of Internal Affairs in Moscow region.
It is established that Kotlyarenko having the citizenship of the United States, in the years of 2005 through 2008, in the composition of an organized criminal group which was lead by him, committed a misappropriation of monetary funds of an OJSC "IKMO" in the amount of over 1 billion rubles invested by the Government of Moscow region into the construction of housing.
The concluded in the framework of the implementation of the joint criminal enterprise fictitious contract envisaged for the construction of a residential complex in the city of Klin in Moscow region. For realization of this agreement there have been obtained targeted loans for the development of mortgage crediting in accordance with the program of Government of Moscow region. However, this contract aimed to create the appearance of economic activity. In reality it was not planned any implementation of construction of a residential complex at all.
As a result of complicated criminal schemes the mentioned monetary funds were misappropriated – transferred to Bank accounts in offshore zones.
Moreover, at the present time, there is a criminal case in the execution stage of the Investigative Committee of the Ministry of Internal Affairs of Russia under which Kotlyarenko is subject to criminal liability for misappropriation by fraud in complicity with other persons of monetary funds in the amount of about 24 billion rubles, acquisition of the right to claim the property for the amount of about 5.5 billion rubles and the subsequent withdrawal of these assets of the Government of Moscow region abroad. Also, by the investigating authorities of Moscow region Kotlyarenko is accused of misappropriating of shares of the Podolsk chemical plant in the amount of 2 billion and 875 million rubles.
Since Kotlyarenko disappeared from the law-and-order bodies, in December 2008 he was declared in the Federal search and in March 2009 he was placed into the international wanted list.
In March 2009 Kotlyarenko was detained on the territory of Cyprus and in April 2009 the General Prosecutor's office of the Russian Federation forwarded to the Ministry of justice and public order of the Republic of Cyprus a request about extradition of Kotlyarenko for bringing to criminal liability.
Consideration of an extradition request by the District court of the city of Larnaca (Cyprus) lasted from November 2009 with the involvement of representatives of the Russian Federation as witnesses.
On July 8th of this year the extradition request of Kotlyarenko was satisfied by the district court of the city of Larnaca and the mentioned person was placed in custody with the aim of subsequent extradition to Russia. However, Kotlyarenko appealed against the decision about his extradition to a higher court two times.
On March 17th of this year the Supreme court of the Republic of Cyprus issued a final decision about the extradition of Dmitry Kotlyarenko to Russia.
Achievement of the positive result at considering by the Cypriot court of the case concerning extradition of Kotlyarenko became possible in the result of close cooperation of the General Prosecutor's office of the Russian Federation and the General Prosecutor's office of the Republic of Cyprus, the representative of which took part in the process as the side of prosecution.
Today, accompanied by the employees of the Russian Bureau of Interpol, Kotlyarenko is extradited to Russia.
