The General Prosecutor's office of the Russian Federation approved the indictment on the criminal case against the former General Director of the Federal state unitary enterprise "Arktikmorneftegazrazvedka" Oleg Mnatsakanyan. He is accused of committing a crime foreseen by article 201 of the criminal code of the Russian Federation (abuse of power).
The reason for excitation of this case was the apply to the General Prosecutor’s office of the Russian Federation submitted by the new management of the Federal state unitary enterprise "Arktikmorneftegazrazvedka" with the request to take measures of internationally legislative nature to return to Russia from abroad a unique sea drilling ship of ice class "Valentin Shashin" costing about US$ 300 million, provided for carrying out exploration and extraction of hydrocarbon raw materials on the Arctic shelf.
In spite of the fact that the investigative bodies for a long time did not take legal decision on the given issue, the General Prosecutor's office of the Russian Federation on April 15, 2010 managed to achieve excitation of a criminal case, which was taken under execution by the Investigative Committee of the Ministry of Internal Affairs of Russia.
According to the preliminary investigation in 2005 Mnatsakanyan in violation of the existing legislation and without the consent of the owner, namely Federal property management Agency, illegally transferred in rent to Norwegian companies "ARBA AS" and "Vеnturе Drilling AS" with the term of 18 years the ship "Valentin Shashin". Without taking into account the real market prices for rent of similar property Mnatsakanyan has signed a contract of chartering of the ship (bareboat Charter) by establishing an obviously underestimated rate of rent in the amount of 21 thousand dollars a day.
In their turn, foreign tenants having an opportunity to dispose of this property, without any delay handed over the ship "Valentin Shashin" into sublease and used it in their benefit until 2011 and gaining from 250`000 up to 400`000 euro a day. At the same time, without the knowledge of the Russian owner, they have changed the name of the ship to "Deep Venture" and entered it into the international register of the sea vessels and this fact could lead to complete loss of the property for our state in the future.
In order to prevent the occurrence of the above mentioned grave consequences, the General Prosecutor's office of Russia, together with the Investigative Committee of the Ministry of Internal Affairs in the framework of the criminal proceedings carried out a complex of the actions of the international legislative nature and as a result of which it was possible to determine the dislocation of the "Valentin Shashin" in one of the ports on the Atlantic coast of Africa and to obtain from the Norwegian tenants its return to the owner in February 2011 together with the additionally installed equipment on it, the value of which is estimated at about 150 million dollars.
Timely intervention of the General Prosecutor's office of Russia to the arbitration process on the side of the Federal Property Management Agency largely contributed to this result and as an outcome of which the contract of rent of the ship was declared illegal and cancelled.
Moreover, with the participation of the General Prosecutor's office of the Russian Federation in arbitration proceedings Federal State Unitary Enterprise "Arktikmorneftegazrazvedka" was given back the rescue-diving vessel "SPRUT", which was also illegally transferred into rent to foreign companies.
The criminal case concerning Mnatsakanyan was submitted to the Pervomayskiy district court of the city of Murmansk for consideration on the facts.
