About the extradition to Russia from the Kingdom of Belgium of a citizen of the Russian Federation Minas Nalbandyan accused of illegal purchase and possession of weapons

Today, upon the request of the General Prosecutor's office of the Russian Federation, the competent authorities of the Kingdom of Belgium are extraditing to Russia a citizen of the Russian Federation Minas Nalbandyan. In April 2004, by the Gvardeyskiy district court of Kaliningrad region, he was found guilty in committing a crime foreseen by part 1 of article 222 (illegal purchase and possession of firearms) of the Criminal code of the Russian Federation and was sentenced to 3 years of conditional imprisonment with a probation period of three years.

From the sentence of the court it is appeared that Nalbandyan illegally purchased and possessed for a long time in his apartment in the village of Ozerki of Gvardeyskiy district of Kaliningrad region a pistol "IZH-71" of caliber of 9 mm with 9 pistol cartridges.

Since Nalbandyan avoided serving the punishment and disappeared from the law enforcement authorities of the Gvardeyskiy district court in February 2005 by its resolution repealed the conditional sentence and decided to forward Nalbandyan for serving the punishment in a colony - settlement, and also announced him in the federal search, and in February 2007 he was placed into the international wanted list.

In June 2007 it became known about residing of the mentioned person in the territory of Belgium but he was not liable to detention for the purposes of extradition because of the fact that the Belgian authorities granted him refugee status. Due to this fact in October 2007 the General Prosecutor's office of the Russian Federation forwarded to the Ministry of justice of the Kingdom of Belgium a petition on deprivation of Nalbandian of this status and on detention with the purpose of extradition, and in November 2007 forwarded a request for his extradition.

Having the status of a refugee Nalbandyan freely crossed the countries of the European Union, and in March 2009 he was detained in Spain, however, the authorities of that state in July 2009 refused to extradite him to Russia due to the fact that Nalbandyan possessed a refugee status.

By the General Prosecutor's office of the Russian Federation jointly with the Russian Embassy in Belgium it was a huge work targeted towards achievement of a positive result in solving the issue on depriving Nalbandian of a refugee status which was obtained in violation of the Convention relating to the status of refugees of 1951. In April 2010 the Belgian authorities deprived Nalbandyan of this status by the reason of hiding from them of the fact that he was brought to criminal liability in the territory of the Russian Federation, and returned to consideration of the issue of his extradition to the Russian Federation.

In May 2011 Nalbandyan was arrested by the Belgian law enforcement authorities when he was trying to escape with a car. As a result of the chase there were damaged several cars and during detention weapon and fake documents were found about him.

In March 2012 despite numerous complaints of Nalbandyan, the Belgian authorities adopted the final decision on his extradition to Russia.

Today, accompanied by the employees of the FSIN (Federal Service of Execution of Punishment) of Russia and the Russian Bureau of Interpol, Minas Nalbandyan is extradited to Russia.
