Today, on 23 September 2015 at the request of the Prosecutor General’s Office of the Russian Federation the competent authorities of the Slovak Republic are extraditing to Russiathe citizen of the Russian Federation Ali Ibragimov.
Investigative authorities accuse him of committing crimes under Part 2 of Article 209 (banditry) and Article 317 (infringement on life of the law enforcement officer) of the Criminal Code of the Russian Federation.
Pending criminal case in relation to Mr. Ibragimov is under examination by theInvestigative Departmentof the Investigative Committee of the Russian Federation for the Chechen Republic.
The investigation established that the bandit group comprising of Mr. Ibragimov along with other persons was formed in 2001 within the territory of the city of Grozny.
The members of the group have purchased explosives, firearms, ammunition, vehicles, communication devices, as well as items of technical equipment.
In June 2001 Mr. Ibragimov and other members of the group moving in car in Grozny city, with the aim to impede the legitimate activities of the Riot Policeof the Directorate ofInternal Affairs of the Ministry of Internal Affairs of Russia in the Chechen Republic,has firedseveral shotsat the officers. As a result of the receivedgunshot wounds two victims died at the scene of the accident.
As Mr. Ibragimov fled from prosecution he was declared internationally wantedin March 2006.
Due to the establishment of his location on the territory of Slovakia the Prosecutor General’s Office of the Russian Federation has submitteda request for his extraditionto competent authorities of this statein April 2006, which was further satisfied in July 2015.
Trying to avoid extraditionMr. Ibragimov applied to the Slovak authorities with a petition for refugee status.Howeverthis application was rejected.
In addition he lodged complaints twice with the European Court of Human Rights about the decision of the Slovak judicial authorities onhis extradition to Russia in connection with which the extradition procedure was suspended. The Russian Federation entered into the process as a third partyjustifying the legitimacy of itsrequest for the extradition of the accused forprosecution.
As a result, on 14 September 2010 and on 30 June 2015the European Court of Human Rights acknowledged the complaints of Mr.Ibragimov as unacceptable, and rejected the applicant’s arguments concerning the possible violation of the provisions of Articles 3 and 6 of the European Convention on Human Rights in case of his extradition as groundless.
Mr.Ibragimov will be extradited to Moscow escorted by special convoy.
